Terms of Service

These Terms of Service ("Terms") govern your use of the Nexova Captions application ("the App"), provided by Nexova Dev LLC ("we", "us", "our"). By downloading, accessing, or using the App you agree to be bound by these Terms.

1. License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial content creation on your own devices, subject to these Terms. All rights not expressly granted are reserved.

2. Subscriptions and auto-renewing billing

• The App offers auto-renewing subscriptions (weekly, monthly, and yearly plans) as well as free trial periods. Prices and subscription lengths are displayed in the App before purchase.
• Payment is charged to your App Store account at confirmation of purchase.
• Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
• Your App Store account is charged for renewal within 24 hours prior to the end of the current period.
• You can manage or cancel subscriptions at any time in your App Store account settings (Settings > Apple ID > Subscriptions).
• If a free trial is offered, it begins when you confirm the purchase. Unused portions of a free trial are forfeited if you purchase a subscription during the trial period.
• Cancelation takes effect after the current billing period ends; no partial refunds are provided for the remaining period of an active subscription.

3. Fair usage

The free tier is limited to a reasonable number of captioning requests per day and includes a watermark on exported videos. Subscribers receive increased limits and no watermark, as described in the App. We reserve the right to adjust free-tier limits to ensure service quality for all users.

4. Acceptable use

You agree not to use the App to create or distribute content that is unlawful, defamatory, harassing, hateful, infringing, or that violates the rights of third parties. You are solely responsible for the content you create and share with the App.

5. Intellectual property

The App, including its design, code, and branding, is the property of Nexova Dev LLC and is protected by applicable laws. You may not copy, modify, reverse engineer, or redistribute the App except as permitted by law. Content you create with the App belongs to you.

6. Disclaimer of warranties

The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including accuracy of transcriptions. Captions are generated automatically and may contain errors; we recommend reviewing captions before publishing your content.

7. Limitation of liability

To the maximum extent permitted by law, Nexova Dev LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of the App.

8. Changes to these Terms

We may update these Terms from time to time. The latest version will always be available at this page. Continued use of the App after changes constitutes acceptance of the updated Terms.
